Terms and Conditions Privacy Policy Legal GENERAL SERVICES: Tech Pros San Diego (TPSD) will attempt to diagnosis your computer problem, provide an estimate of applicable service fees and taxes, and then provide you with a solution. There are times, however, when support may not be completed because of a problem with your computer or its configuration that is beyond our control. Note – computer problems as described by a client can be completely erroneous – TPSD bases an initial estimate on the best information available as described by the client. Often, upon further investigation, more information comes to light which causes TPSD to revise the initial estimate. YOUR RESPONSIBILITY: You understand and agree that prior to contacting or allowing TPSD to perform diagnostic repair or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that TPSD shall not be responsible under any circumstance for any loss or corruption of data and/or software. INSTALLATION AUTHORIZATION: For on-site services, a person at least 18 years of age must be present during the entire time period services are provided. If no adult is present when the TPSD representative arrives, services will be denied and a $49 cancellation charge will be assessed. The “We Fix It or You Don’t Pay” Guarantee means that TPSD will still charge for labor if the client opts not to take our advice. If we know the course of action required to resolve the issue in question, yet decides not to take that action, TPSD is entitled to the labor expended up until that point. BILLING: TPSD bills by the hour and has a 1-hr minimum – the clock starts once this form is signed “accepted” and stops when signed “complete.” The relationship between TPSD and client is terminated upon payment for goods and services. TPSD reserves the right to refuse service to anyone for any reason. TPSD does not enter into any partnership expressed or implied with client. TPSD and client have no outside agreements except what is included here in this agreement. TPSD operates on a “time and materials” basis. Payment for services and all hardware costs are due and payable upon delivery of goods and services. A penalty of 10% of outstanding balance due will be assessed if payment is not received at project completion. MINIMUM SYSTEM REQUIREMENTS *At least 10MB free hard disk space and 32 MB RAM on each computer *Operating system and/or ISP passwords must be available *Microsoft Windows 98 SE operating system or later *Operating system discs and key codes must be available *All computers and/or peripherals must be in good working order and spyware free ACCESS: The TPSD representative must have 1) access to your residence or business and the computer(s) and/or peripheral(s) to be serviced, 2) your consent and cooperation to enter your residence or business, 3) a safe working environment, work space, and 4) electrical power. If the TPSD representative determines that these conditions have not been met, services will be denied and a $49 cancellation charge assessed. SERVICE LIMITATIONS: LIABILITY: (a) LIMITATIONS TO SERVICE: TPSD RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SUPPORT SERVICES, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY TPSD. (b) FORCE MAJEURE: If TPSD's ability to render remote services is impaired by you or circumstances beyond the control of TPSD, TPSD may choose not to provide or to discontinue remote services. (c) LIMITATION OF LIABILITY: To the extent permitted by law, you agree that TPSD’ total liability for damages related to its support services is limited to the total amount you pay for the services, and you release TPSD from liability for any indirect, incidental, special, or consequential damages. We strongly advise all of our clients to perform regular and thorough backups. In no event will TPSD be held liable for any direct or indirect, incidental or consequential damage, loss of use, loss of data, or other malady arising from purchase or use of products or services provided by TPSD. TPSD IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT. SERVICE WARRANTY: If you are not satisfied with support services received from TPSD, please call 1-800-572-6076 for resolution. We warrant our services for 5 days following the date you received tech support service; however, for repairs necessitated by a virus or spyware, the service warranty is valid only if the anti-virus and anti-spyware protection for your product is installed or updated during the repair or promptly thereafter (i.e., before you connect again to the Internet). If there is a problem with the service provided by TPSD and if you notify us within the warranty period, we will work to remedy your problem quickly and at no additional cost.
